Please read these Terms carefully before making a booking. By completing a booking and making payment, you confirm that you have read, understood and agree to be bound by these Terms, including house rules.
1. About us and definitions
1.1 These Terms (hereinafter – "Terms") govern the rental of holiday accommodation properties (hereinafter – "Property" or "Properties") through the website www.comfyrest.lt (hereinafter – "Website"), administered by:

1.2 Comfy Rest tiesiogiai valdo ir (arba) administruoja visus Svetainėje skelbiamus Objektus. Mes nesame rezervacijos platforma ar tarpininkas – mes esame apgyvendinimo paslaugų teikėjas.
1.3 In these Terms:
"Guest" or "you" – the person making the booking and all members of their group.
"Lead Guest" – the person who makes the booking and accepts these Terms. The Lead Guest must be at least 18 years old and have the legal capacity to enter into a binding contract.
"Booking" – konkretaus Objekto rezervacija konkrečioms datoms, patvirtinta pagal 2.3 skyrių.
"Booking Confirmation" – a written confirmation email sent by us following successful payment.
"Rental Amount" – the total accommodation price, including all applicable taxes and mandatory charges, shown at the time of booking.
"Rental Period" – the period from the check-in date to the check-out date stated in the Booking Confirmation.
"House Rules" – the specific rules applicable to each Property, published on the Property listing page of the Website and provided in the Booking Confirmation.
"Booking Deposit" – a €200 advance payment included in the total Rental Amount, applicable to high season bookings. Described in section 4.
2. Booking process and formation of contract
2.1 How to make a booking. Bookings are made through the Website by selecting a Property, dates, entering Guest details, accepting these Terms and completing payment. A booking request does not become a binding contract until the conditions set out in clause 2.3 are fulfilled.
2.2 Accuracy of information. The Lead Guest is responsible for ensuring that all information provided during the booking process is accurate and complete, including the names and number of all guests staying at the Property.
2.3 When the contract is formed. A binding rental contract (hereinafter – "Contract") between you and Comfy Rest is formed when both of the following conditions are met: both conditions: (a) payment has been successfully processed (full amount or deposit as per section 4); and (b) we have sent the Booking Confirmation to the specified email address. Until both conditions are fulfilled, no binding contract exists.
2.4 Lead Guest responsibility. The Lead Guest is responsible for ensuring that all members of their group comply with these Terms and the House Rules. The Lead Guest is liable for any breaches committed by any member of the group.
2.5 Right of withdrawal does not apply. Under Article 16(l) of the EU Consumer Rights Directive (2011/83/EU) and Article 6.228¹⁰(2) of the Civil Code of the Republic of Lithuania, the 14-day right of withdrawal does not apply to accommodation services booked for specific dates. By completing a booking, you acknowledge that you waive the right of withdrawal that would otherwise apply to distance contracts. Your right to cancel a booking is governed exclusively by the cancellation policy set out in section 5.
2.6 Pre-contractual information. Before completing a booking, you will be provided with: the main characteristics of the accommodation; the total price including all charges; payment terms and schedule; cancellation policy; information that the right of withdrawal does not apply; and information about the complaints procedure and dispute resolution.
3. Property description and obligations
3.1 We make all reasonable efforts to ensure that descriptions, photographs and lists of amenities on the Website are accurate and up to date. However, Properties are furnished holiday homes, and minor discrepancies from photographs (e.g. replacement of furniture with items of equivalent quality, seasonal garden changes) do not constitute a material defect.
3.2 Mes negarantuojame jokių patogumų, priklausančių nuo trečiųjų šalių paslaugų, prieinamumo, įskaitant, bet neapsiribojant, interneto ryšį, televizijos kanalus, šildymo/vėsinimo sistemas ar vietines infrastruktūras. Laikini komunalinių paslaugų sutrikimai nesuteikia Svečiui teisės į kompensaciją, nebent Objektas tampa netinkamas gyventi.
3.3 We will maintain the Property in a clean and habitable condition. If upon arrival you notice any defect or cleanliness issue, you must inform us within 4 hours of arrival, so that we can rectify the situation.
4. Prices and payment
4.1 Pricing. All prices stated on the Website are in euros (EUR) and include applicable VAT at the rate in force at the time of booking (currently 12 % for accommodation services in Lithuania). The total price shown at checkout includes the rental fee, mandatory cleaning fee (if applicable) and other mandatory charges. Tourist tax (if applicable under municipal regulation) is charged separately and will be clearly stated during the booking process and in the Booking Confirmation.
4.2 What is not included. Unless expressly stated otherwise, the Rental Amount does not include: additional services (early check-in, late check-out, additional cleaning, linen sets, etc.); costs arising from damage or breach of House Rules; personal expenses.
4.3 Payment methods and booking deposit. Payment terms depend on the dates of stay:
Sezono metu (birželio 1 d. – rugpjūčio 31 d.):
(a) Full advance payment: the full Rental Amount is paid at the time of booking through the website.
(b) Pay on arrival with booking deposit: a booking deposit is paid at the time of booking: €200 booking deposit (advance payment included in the total Rental Amount). The remaining balance is paid on the day of arrival. The booking deposit is non-refundable if cancellation is made less than 30 days before arrival (see section 5).
Ne sezono metu (rugsėjo 1 d. – gegužės 31 d.):
(a) Full advance payment: the full Rental Amount is paid at the time of booking through the website.
(b) Pay on arrival: Nuomos suma mokama pilnai atvykimo dieną. Rezervacinis mokestis netaikomas.
4.4 Payment processing. Payments are securely processed through Paysera (UAB "Paysera LT", electronic money institution licence No. 1, supervised by the Bank of Lithuania). By making payment, you authorise us to charge the specified amounts from your chosen payment method through Paysera. Comfy Rest does not store your payment card details – all card data is processed exclusively by Paysera in accordance with PCI DSS security standards and Strong Customer Authentication (SCA) requirements under PSD2.
4.5 No surcharges. We do not apply any additional charges depending on your chosen payment method. All transactions are conducted in EUR. If your bank account or card is in another currency, your financial institution may apply its own exchange rate and/or conversion fees. Upon successful payment, you will receive a Booking Confirmation email with all booking details.
4.6 Booking confirmation and payment receipt. Upon successful payment, you will receive a Booking Confirmation email containing: Property details, Rental Period dates, amount paid/payable, payment schedule (if applicable), check-in instructions and a link to these Terms and applicable House Rules.
5. Cancellations and modifications
5.1 Guest cancellation. All cancellation requests must be submitted in writing by email to rest@comfyrest.lt. The cancellation date is the day on which we receive your written notice.

5.2 Refund processing. Refunds will be made using the same payment method used for the original payment, through Paysera. Please allow up to 14 working days, for the refund to appear in your account, although card refunds may take longer (up to 60 days) depending on your card issuer.
5.3 Travel insurance. We strongly recommend that all Guests obtain comprehensive travel insurance covering cancellation, curtailment, public liability and personal property for the duration of the stay.
5.4 Guest-requested modifications. Requests to modify a confirmed booking (dates, Property or number of guests) must be submitted in writing at least 30 days before the arrival date. Modifications are subject to availability and may result in a price recalculation. An administration fee of €25 per modification may apply. Modification requests received less than 30 days before arrival will be treated as a cancellation of the original booking and a new booking, subject to the cancellation policy above.
5.5 Transfer of booking. The Lead Guest may transfer the booking to another person who meets all booking conditions, provided that: (a) written notice is given at least 30 days before the arrival date; (b) the new Lead Guest accepts these Terms; and (c) an administration fee of €25 is paid. Both the original and the new Lead Guest are jointly and severally liable for the Rental Amount and other obligations under these Terms.
5.6 Comfy Rest atšaukimas. Jei Comfy Rest atšaukia rezervaciją ne dėl Svečio kaltės, grąžinamos visos sumokėtos sumos, įskaitant rezervacinį mokestį.
6. Check-in, check-out and access
6.1 Check-in. Check-in is available from 15:00 on the day of arrival. If you plan to arrive outside standard check-in hours, please inform us in advance. Late arrival after 21:00 may be possible by prior arrangement.
6.2 Check-out. Check-out must be completed by 11:00 on the day of departure. The Property must be left in a reasonably tidy condition: dishes washed, rubbish placed in designated containers, all windows and doors locked. Keys must be returned to the designated location as per the Booking Confirmation or check-in instructions.
6.3 Late check-out. Vėlyvas išvykimas gali būti galimas paprašius ir priklauso nuo prieinamumo. Jei Svečias neatlaisvina Objekto iki išvykimo laiko be išankstinio susitarimo, mes pasiliekame teisę nuskaityti papildomos nakvynės mokestį.
6.4 Lost keys. A replacement fee of €50 applies for lost keys.
6.5 Guest identification and registration. Under Article 32(3) of the Law on Tourism of the Republic of Lithuania, all accommodation providers in Lithuania are required to register each guest in the national E.tourist system (National Tourism Information System). Upon arrival, all guests must present a valid identity document. We are required to collect: first and last name; date of birth; name of the country that issued the identity document; number of accompanying minor children; place of residence (country and city); dates of arrival and departure; indication of whether the guest arrived through a tour operator; main purpose of travel (leisure, work, health, other). Nepateikus reikalaujamų asmens duomenų, Comfy Rest turi teisę atsisakyti teikti apgyvendinimo paslaugą, o mokėjimo grąžinimas nebus taikomas. Šis duomenų rinkimas yra teisinė prievolė pagal Lietuvos teisę; BDAR teisinis pagrindas yra 6 straipsnio 1 dalies c punktas. Išsamesnę informaciją rasite mūsų Privacy Policy.
6.6 Right of access. We or our authorised representatives reserve the right to access the Property at reasonable times for essential repairs, safety inspections or emergencies. Except in emergencies, we will give at least 24 hours advance notice.
7. Use of the Property and house rules
7.1 Permitted use. The Property is provided exclusively for holiday accommodation purposes. The Property may not be used for any commercial purposes, sublet or transferred to third parties.
7.2 Maximum occupancy. The maximum number of persons permitted to stay overnight at the Property is stated in the Property listing and in the Booking Confirmation (including children of all ages). Only persons named in the booking or subsequently confirmed by us in writing may stay overnight. If more persons than permitted are staying at the Property, we reserve the right to: (a) require the excess persons to leave immediately; or (b) terminate the booking immediately without refund.
7.3 House Rules. The House Rules for each Property are published on the Property listing page, included in the Booking Confirmation and available at the Property. By completing the booking, you confirm that you have read and agree to the House Rules. The House Rules form an integral part of this Contract. A material breach of the House Rules may result in immediate termination of the booking without refund.
7.4 Smoking. Smoking (including electronic cigarettes and vaping devices) strictly forbidden in all Properties. A minimum cleaning fee applies for breach of this policy: 100 €. If the actual cleaning costs exceed this amount, the Guest is liable for all costs. Repeated breach may result in immediate termination without refund.
7.5 Pets. Augintiniai leidžiami tik Svetainėje aiškiai pažymėtuose Objektuose. Kai augintiniai leidžiami: Objekte leidžiami daugiausiai 2 augintiniai; taikomas papildomas mokestis €10 už augintinį už nakvynę; augintiniai negali būti palikti vieni Objekte; augintiniai negali būti ant lovų ar minkštasuolių; Svečias atsako už savo augintinio(-ių) tvarkymą; bet kokia augintinių padaryta žala bus išskaičiuota iš Svečio. Mes negarantuojame, kad ankstesni svečiai nebuvo atvežę augintinių į Objektą.
7.6 Quiet hours and noise. Guests must maintain a reasonable noise level at all times. Under the Lithuanian Law on Noise Management (No. IX-2499), quiet hours are observed daily from 22:00 to 08:00. During quiet hours all outdoor activities must cease and the volume of music and entertainment must be reduced so as not to be audible beyond the Property boundaries. Parties, celebrations and group events are prohibited without our prior written consent. Breach of noise rules may result in a formal warning, and repeated or serious breaches may result in immediate termination of the booking without refund, and the Guest may be subject to administrative fines under Lithuanian law (€80–200 per person).
7.7 Illegal activity. Any illegal activity at the Property will result in immediate termination of the booking, eviction of all guests and notification of law enforcement authorities. No refund will apply.
8. Guest liability and damage
8.1 Svečias yra atsakingas ir sutinka kompensuoti Comfy Rest už bet kokius nuostolius ar žalą Objektui, jo turiniui, įrenginiams ir baldams, padarytą Svečio ar bet kurio jo grupės nario Nuomos laikotarpiu, nesvarbu, ar žala padaryta dėl neatsargumo, tyčinių veiksmų ar kitų priežasčių.
8.2 Any damage must be reported to ComfyRest immediately pranešti Comfy Rest susisiekus telefonu +37064569999 arba el. paštu: rest@comfyrest.lt. Failure to report damage does not release the Guest from liability but may affect the damage assessment.
8.3 Svečias yra atsakingas už Objekto saugumą (durų ir langų užrakinimą) paliekant Objektą be priežiūros. Comfy Rest neatsako už Svečio asmeninių daiktų vagystę ar žalą.
8.4 Svečio atsakomybė pagal šį skyrių nėra ribojama. Užbaigdami rezervaciją jūs sutinkate, kad nustačius Objekto sugadinimą ar Vidaus taisyklių pažeidimą (pvz., baudą už rūkymą, pamestus raktus), mes pasiliekame teisę atitinkamas sumas išskaičiuoti naudojant tą patį mokėjimo būdą, kurį naudojote atlikdami rezervaciją.
9. Our liability
9.1 Scope of liability. To the maximum extent permitted by Lithuanian law:
(a) Our total cumulative liability for all claims relating to a single booking shall not exceed the total Rental Amount paid by the Guest for that booking.
(b) We are not liable for any indirect, incidental or consequential losses, including but not limited to: loss of enjoyment; additional travel or accommodation costs; loss of earnings or income; or any non-pecuniary loss – except where such limitation of liability is prohibited by law.
(c) We are not liable for: temporary utility disruptions; noise or disturbance from neighbouring properties, construction, public works or events beyond our control; adverse weather conditions; changes to local amenities, shops, restaurants or public services; acts or omissions of third parties unconnected with the performance of our Contract.
9.2 Duty to mitigate. The Guest must take reasonable steps to mitigate losses. In particular, if a problem arises during the stay, you must inform us immediately (see clause 11.1) so that we can resolve it before seeking alternative accommodation or incurring additional costs.
10. Force majeure
10.1 Neither party shall be liable for any failure or delay in performing their obligations under this Contract if such failure or delay arises from force majeure circumstances under Article 6.212 of the Civil Code of the Republic of Lithuania and Government Resolution No. 840 (15 July 1996), including but not limited to: war or armed conflict; terrorism; natural disasters; epidemics or pandemics; government-imposed restrictions, quarantine measures or border closures; fire or explosion; prolonged electricity or infrastructure failure; strikes or industrial action; and any other event beyond the reasonable control of the affected party, provided that the four conditions of Article 6.212 are satisfied.
10.2 Notification. The party affected by force majeure must promptly notify the other party in writing upon becoming aware of the force majeure event, stating the nature and expected duration of the event. Exemption from liability takes effect from the date the obstacle arose, if notice is given in time, or from the date of notification if notice is delayed.
10.3 Consequences. Force majeure atveju, kai Svečias negali atvykti į Objektą arba Comfy Rest negali suteikti Objekto pagal Sutartį:
(a) The Guest will be offered the choice of: (i) rescheduling dates within 12 months (priklausomai nuo prieinamumo ir kainos skirtumo); arba (ii) grąžinti visas sumokėtas sumas, atėmus bet kokias pagrįstas neatgautinas Comfy Rest patirtas išlaidas (dokumentuotas ir detaliai nurodytas) ir administracinį mokestį, neviršijantį €50.
(b) Neither party shall be entitled to compensation for consequential or indirect losses arising from force majeure.
10.4 If the force majeure circumstance continues for more than 60 days, either party may terminate the Contract by written notice, and any refund will be made in accordance with clause 10.3(a)(ii).
11. Complaints and dispute resolution
11.1 During the stay. If any problem arises during the stay, please contact us immediately on +37064569999 or by email at rest@comfyrest.lt. Many issues can be resolved quickly if reported promptly. Complaints regarding cleanliness must be submitted within 4 hours of arrival. We aim to resolve issues during the stay wherever possible.
11.2 After the stay. If a complaint was not resolved during the stay, you must submit a written complaint by email to rest@comfyrest.lt within 14 days of the end of the Rental Period, providing a clear description of the problem and any supporting evidence (photographs, correspondence). We will acknowledge receipt of your complaint within 5 working days and provide a substantive response within 14 calendar days of receipt.
11.3 Alternative dispute resolution (ADR). If we are unable to resolve your complaint to your satisfaction, you may refer the matter to the competent alternative dispute resolution body in Lithuania:

Before approaching SCRPA, you must first attempt to resolve the dispute directly with ComfyRest. If you do not receive a satisfactory response within 14 calendar days, you may submit a complaint to SCRPA.

11.4 Applicable law. This Contract shall be governed by and construed in accordance with the law of the Republic of Lithuania .
11.5 Jurisdiction. Any disputes arising out of or in connection with this Contract that cannot be resolved through the ADR procedure above shall be determined by the competent courts of the Republic of Lithuania.
12. Personal data protection and privacy
12.1 Comfy Rest (UAB Limo Trading Company) yra data controller for personal data collected through the Website and in the provision of accommodation services. We process your personal data in accordance with Regulation (EU) 2016/679 (GDPR) and the Law on Legal Protection of Personal Data of the Republic of Lithuania.
12.2 Data collected. Rezervacijos proceso metu ir viešnagės metu renkame: vardą ir pavardę, el. pašto adresą, telefono numerį, pašto adresą, rezervacijos duomenis, mokėjimo informaciją (apdorojamą Paysera – žr. 12.4 punktą) ir svečių identifikavimo duomenis, reikalingus turizmo registracijai (žr. 6.5 punktą).
12.3 Legal bases. We process personal data on the following legal bases:
Performance of contract (GDPR Art. 6(1)(b)): for the fulfilment of your booking and provision of accommodation services;
Legal obligation (GDPR Art. 6(1)(c)): guest registration under the Tourism Act, maintenance of accounting and tax records;
Legitimate interest (GDPR Art. 6(1)(f)): communication regarding your booking, service improvement and fraud prevention;
Consent (GDPR Art. 6(1)(a)): marketing communications (where separately consented to).
12.4 Payment data. Payment card data is processed exclusively by Paysera (UAB "Paysera LT"), licencijuota elektroninių pinigų įstaiga (licencija Nr. 1, Lietuvos bankas). Paysera veikia kaip duomenų tvarkytojas mūsų vardu mokėjimų apdorojimo tikslais ir kaip savarankiškas duomenų valdytojas dėl savo reguliavimo prievolių (pinigų plovimo prevencija ir kt.). Comfy Rest negauna, neprieina prie jūsų pilnų mokėjimo kortelės duomenų ir jų nesaugo. Paysera privatumo politika ir paslaugų teikimo sąlygos prieinamos adresu www.paysera.com.
12.5 Privacy Policy. Detailed information on how we collect, use, retain and protect your personal data – including data retention periods, your rights as a data subject, the use of cookies and how to exercise your rights – is set out in our Privacy Policy, prieinamoje adresu www.comfyrest.eu/privatumo-politika. Privatumo politika yra neatskiriama šių Sąlygų dalis.
12.6 Supervisory authority. You have the right to lodge a complaint regarding our data processing practices with the State Data Protection Inspectorate (SDPI), L. Sapiegos g. 17, LT-10312 Vilnius; email: ada@ada.lt; www.ada.lt.
13. General provisions
13.1 Entire agreement. Šios Sąlygos kartu su Rezervacijos patvirtinimu, Vidaus taisyklėmis ir Privatumo politika sudaro visą susitarimą tarp jūsų ir Comfy Rest dėl Objekto rezervacijos ir naudojimo.
13.2 Severability. If any provision of these Terms is found by a competent court or authority to be invalid, unlawful or unenforceable, that provision shall be amended to the minimum extent necessary to make it valid and enforceable, or, if amendment is not possible, it shall be severed, and the remaining provisions shall continue in full force.
13.3 Waiver. Mūsų nesugebėjimas pasinaudoti kokia nors teise ar nuostata pagal šias Sąlygas nereiškia tos teisės ar nuostatos atsisakymo. Bet koks atsisakymas turi būti raštu ir pasirašytas Comfy Rest įgalioto atstovo.
13.4 Sąlygų pakeitimai. We reserve the right to update these Terms from time to time. The version of the Terms in force at the time of your booking applies to that booking. Material changes will be published on the Website with a new effective date. Continued use of the Website after updated Terms are published constitutes acceptance of those Terms for future bookings.
13.5 Kalba. Šios Sąlygos skelbiamos lietuvių ir anglų kalbomis. Esant neatitikimų tarp kalbinių versijų, pirmenybė teikiama lietuvių kalbos versijai.
