By completing a booking and making payment, you confirm that you have read, understood and agree to be bound by these Terms, including <a href=\"https:\/\/comfyrest.eu\/en\/comfy-rest-vidaus-tvarkos-taisykles\/\">house rules<\/a>.<\/b><\/p>\r\n<h4 class=\"wp-block-heading\"><b>1. Mes nesame rezervacijos platforma ar tarpininkas \u2013 mes esame apgyvendinimo paslaug\u0173 teik\u0117jas.<\/span><\/p>\r\n<p><b>1.3 <\/b><span style=\"font-weight: 400;\">In these Terms:<\/span><\/p>\r\n<p><b>\"Guest\"<\/b><span style=\"font-weight: 400;\"> or \"you\" \u2013 the person making the booking and all members of their group.<\/span><\/p>\r\n<p><b>\"Lead Guest\"<\/b><span style=\"font-weight: 400;\"> \u2013 the person who makes the booking and accepts these Terms. The Lead Guest must be at least 18 years old and have the legal capacity to enter into a binding contract.<\/span><\/p>\r\n<p><b>\"Booking\"<\/b><span style=\"font-weight: 400;\"> \u2013 konkretaus Objekto rezervacija konkre\u010dioms datoms, patvirtinta pagal 2.3 skyri\u0173.<\/span><\/p>\r\n<p><b>\"Booking Confirmation\"<\/b><span style=\"font-weight: 400;\"> \u2013 a written confirmation email sent by us following successful payment.<\/span><\/p>\r\n<p><b>\"Rental Amount\"<\/b><span style=\"font-weight: 400;\"> \u2013 the total accommodation price, including all applicable taxes and mandatory charges, shown at the time of booking.<\/span><\/p>\r\n<p><b>\"Rental Period\"<\/b><span style=\"font-weight: 400;\"> \u2013 the period from the check-in date to the check-out date stated in the Booking Confirmation.<\/span><\/p>\r\n<p><b>\"House Rules\"<\/b><span style=\"font-weight: 400;\"> \u2013 the specific rules applicable to each Property, published on the Property listing page of the Website and provided in the Booking Confirmation.<\/span><\/p>\r\n<p><b>\"Booking Deposit\"<\/b><span style=\"font-weight: 400;\"> \u2013 a \u20ac200 advance payment included in the total Rental Amount, applicable to high season bookings. Described in section 4.<\/span><\/p>\r\n<h4><b>2. Booking process and formation of contract<\/b><\/h4>\r\n<p><b>2.1 How to make a booking. <\/b><span style=\"font-weight: 400;\">Bookings are made through the Website by selecting a Property, dates, entering Guest details, accepting these Terms and completing payment. A booking request does not become a binding contract until the conditions set out in clause 2.3 are fulfilled.<\/span><\/p>\r\n<p><b>2.2 Accuracy of information. <\/b><span style=\"font-weight: 400;\">The Lead Guest is responsible for ensuring that all information provided during the booking process is accurate and complete, including the names and number of all guests staying at the Property.<\/span><\/p>\r\n<p><b>2.3 When the contract is formed. <\/b><span style=\"font-weight: 400;\">A binding rental contract (hereinafter \u2013 \"Contract\") between you and Comfy Rest is formed when both of the following conditions are met: <\/span><b>both<\/b><span style=\"font-weight: 400;\"> conditions: (a) payment has been successfully processed (full amount or deposit as per section 4); <\/span><b>and<\/b><span style=\"font-weight: 400;\"> (b) we have sent the Booking Confirmation to the specified email address. Until both conditions are fulfilled, no binding contract exists.<\/span><\/p>\r\n<p><b>2.4 Lead Guest responsibility. <\/b><span style=\"font-weight: 400;\">The Lead Guest is responsible for ensuring that all members of their group comply with these Terms and the House Rules. The Lead Guest is liable for any breaches committed by any member of the group.<\/span><\/p>\r\n<p><b>2.5 Right of withdrawal does not apply. <\/b><span style=\"font-weight: 400;\">Under Article 16(l) of the EU Consumer Rights Directive (2011\/83\/EU) and Article 6.228\u00b9\u2070(2) of the Civil Code of the Republic of Lithuania, <\/span><b>the 14-day right of withdrawal does not apply<\/b><span style=\"font-weight: 400;\"> to accommodation services booked for specific dates. By completing a booking, you acknowledge that you waive the right of withdrawal that would otherwise apply to distance contracts. Your right to cancel a booking is governed exclusively by the cancellation policy set out in section 5.<\/span><\/p>\r\n<p><b>2.6 Pre-contractual information. <\/b><span style=\"font-weight: 400;\">Before completing a booking, you will be provided with: the main characteristics of the accommodation; the total price including all charges; payment terms and schedule; cancellation policy; information that the right of withdrawal does not apply; and information about the complaints procedure and dispute resolution.<\/span><\/p>\r\n<h4><b>3. Property description and obligations<\/b><\/h4>\r\n<p><b>3.1 <\/b><span style=\"font-weight: 400;\">We make all reasonable efforts to ensure that descriptions, photographs and lists of amenities on the Website are accurate and up to date. If upon arrival you notice any defect or cleanliness issue, you must inform us within <\/span><b>4 hours of arrival<\/b><span style=\"font-weight: 400;\">, so that we can rectify the situation.<\/span><\/p>\r\n<h4><b>4. Prices and payment<\/b><\/h4>\r\n<p><b>4.1 Pricing. <\/b><span style=\"font-weight: 400;\">All prices stated on the Website are in euros (EUR) and include applicable VAT at the rate in force at the time of booking (currently <\/span><b>12 %<\/b><span style=\"font-weight: 400;\"> for accommodation services in Lithuania). The total price shown at checkout includes the rental fee, mandatory cleaning fee (if applicable) and other mandatory charges. <\/span><b>Tourist tax<\/b><span style=\"font-weight: 400;\"> (if applicable under municipal regulation) is charged separately and will be clearly stated during the booking process and in the Booking Confirmation.<\/span><\/p>\r\n<p><b>4.2 What is not included. <\/b><span style=\"font-weight: 400;\">Unless expressly stated otherwise, the Rental Amount does not include: additional services (early check-in, late check-out, additional cleaning, linen sets, etc.); costs arising from damage or breach of House Rules; personal expenses.<\/span><\/p>\r\n<p><b>4.3 Payment methods and booking deposit. <\/b><span style=\"font-weight: 400;\">Payment terms depend on the dates of stay:<\/span><\/p>\r\n<p><b>Sezono metu (bir\u017eelio 1 d. \u2013 rugpj\u016b\u010dio 31 d.):<\/b><\/p>\r\n<p><b>(a) Full advance payment: <\/b><span style=\"font-weight: 400;\">the full Rental Amount is paid at the time of booking through the website.<\/span><\/p>\r\n<p><b>(b) Pay on arrival with booking deposit: <\/b><span style=\"font-weight: 400;\">a booking deposit is paid at the time of booking: <\/span><b>\u20ac200 booking deposit<\/b><span style=\"font-weight: 400;\"> (advance payment included in the total Rental Amount). The remaining balance is paid on the day of arrival. The booking deposit is non-refundable if cancellation is made less than 30 days before arrival (see section 5).<\/span><\/p>\r\n<p><b>Ne sezono metu (rugs\u0117jo 1 d. \u2013 gegu\u017e\u0117s 31 d.):<\/b><\/p>\r\n<p><b>(a) Full advance payment: <\/b><span style=\"font-weight: 400;\">the full Rental Amount is paid at the time of booking through the website.<\/span><\/p>\r\n<p><b>(b) Pay on arrival: <\/b><span style=\"font-weight: 400;\">Nuomos suma mokama pilnai atvykimo dien\u0105. Rezervacinis mokestis netaikomas.<\/span><\/p>\r\n<p><b>4.4 Payment processing. <\/b><span style=\"font-weight: 400;\">Payments are securely processed through <\/span><b>Paysera<\/b><span style=\"font-weight: 400;\"> (UAB \"Paysera LT\", electronic money institution licence No. 1, supervised by the Bank of Lithuania). By making payment, you authorise us to charge the specified amounts from your chosen payment method through Paysera. Comfy Rest does not store your payment card details \u2013 all card data is processed exclusively by Paysera in accordance with PCI DSS security standards and Strong Customer Authentication (SCA) requirements under PSD2.<\/span><\/p>\r\n<p><b>4.5 No surcharges. <\/b><span style=\"font-weight: 400;\">We do not apply any additional charges depending on your chosen payment method. All transactions are conducted in EUR. If your bank account or card is in another currency, your financial institution may apply its own exchange rate and\/or conversion fees. Upon successful payment, you will receive a Booking Confirmation email with all booking details.<\/span><\/p>\r\n<p><b>4.6 Booking confirmation and payment receipt. <\/b><span style=\"font-weight: 400;\">Upon successful payment, you will receive a Booking Confirmation email containing: Property details, Rental Period dates, amount paid\/payable, payment schedule (if applicable), check-in instructions and a link to these Terms and applicable House Rules.<\/span><\/p>\r\n<h4><b>5. Cancellations and modifications<\/b><\/h4>\r\n<p><b>5.1 Guest cancellation. <\/b><span style=\"font-weight: 400;\">All cancellation requests must be submitted in writing by email to rest@comfyrest.lt. The remaining amount paid is refunded.<br \/><b>Ne sezono metu:<\/b> baudos netaikomos, sumok\u0117ta suma gr\u0105\u017einama pilnai.<\/span><\/p>\r\n<\/td>\r\n<\/tr>\r\n<tr>\r\n<td>\r\n<p><span style=\"font-weight: 400;\">No-show or early departure<\/span><\/p>\r\n<\/td>\r\n<td>\r\n<p><span style=\"font-weight: 400;\">No refund applies.<\/span><\/p>\r\n<\/td>\r\n<\/tr>\r\n<\/tbody>\r\n<\/table>\r\n<h2>\u00a0<\/h2>\r\n<p><b>5.2 Refund processing. <\/b><span style=\"font-weight: 400;\">Refunds will be made using the same payment method used for the original payment, through Paysera. Please allow up to <\/span><b>14 working days<\/b><span style=\"font-weight: 400;\">, for the refund to appear in your account, although card refunds may take longer (up to 60 days) depending on your card issuer.<\/span><\/p>\r\n<p><b>5.3 Travel insurance. <\/b><span style=\"font-weight: 400;\">We strongly recommend that all Guests obtain comprehensive travel insurance covering cancellation, curtailment, public liability and personal property for the duration of the stay.<\/span><\/p>\r\n<p><b>5.4 Guest-requested modifications. <\/b><span style=\"font-weight: 400;\">Requests to modify a confirmed booking (dates, Property or number of guests) must be submitted in writing at least <\/span><b>30 days<\/b><span style=\"font-weight: 400;\"> before the arrival date. Modifications are subject to availability and may result in a price recalculation. An administration fee of \u20ac25 per modification may apply. Modification requests received less than 30 days before arrival will be treated as a cancellation of the original booking and a new booking, subject to the cancellation policy above.<\/span><\/p>\r\n<p><b>5.5 Transfer of booking. <\/b><span style=\"font-weight: 400;\">The Lead Guest may transfer the booking to another person who meets all booking conditions, provided that: (a) written notice is given at least <\/span><b>30 days<\/b><span style=\"font-weight: 400;\"> before the arrival date; (b) the new Lead Guest accepts these Terms; and (c) an administration fee of \u20ac25 is paid. Both the original and the new Lead Guest are jointly and severally liable for the Rental Amount and other obligations under these Terms.<\/span><\/p>\r\n<p><b>5.6 Comfy Rest at\u0161aukimas. <\/b><span style=\"font-weight: 400;\">Jei Comfy Rest at\u0161aukia rezervacij\u0105 ne d\u0117l Sve\u010dio kalt\u0117s, gr\u0105\u017einamos visos sumok\u0117tos sumos, \u012fskaitant rezervacin\u012f mokest\u012f.<\/span><\/p>\r\n<h4><b>6. Check-in, check-out and access<\/b><\/h4>\r\n<p><b>6.1 Check-in. <\/b><span style=\"font-weight: 400;\">Check-in is available from <\/span><b>15:00<\/b><span style=\"font-weight: 400;\"> on the day of arrival. If you plan to arrive outside standard check-in hours, please inform us in advance. Late arrival after <\/span><b>21:00<\/b><span style=\"font-weight: 400;\"> may be possible by prior arrangement.<\/span><\/p>\r\n<p><b>6.2 Check-out. <\/b><span style=\"font-weight: 400;\">Check-out must be completed by <\/span><b>11:00<\/b><span style=\"font-weight: 400;\"> on the day of departure. The Property must be left in a reasonably tidy condition: dishes washed, rubbish placed in designated containers, all windows and doors locked. Keys must be returned to the designated location as per the Booking Confirmation or check-in instructions.<\/span><\/p>\r\n<p><b>6.3 Late check-out. <\/b><span style=\"font-weight: 400;\">V\u0117lyvas i\u0161vykimas gali b\u016bti galimas papra\u0161ius ir priklauso nuo prieinamumo. Jei Sve\u010dias neatlaisvina Objekto iki i\u0161vykimo laiko be i\u0161ankstinio susitarimo, mes pasiliekame teis\u0119 nuskaityti papildomos nakvyn\u0117s mokest\u012f.<\/span><\/p>\r\n<p><b>6.4 Lost keys. <\/b><span style=\"font-weight: 400;\">A replacement fee of \u20ac50 applies for lost keys.<\/span><\/p>\r\n<p><b>6.5 Guest identification and registration. <\/b><span style=\"font-weight: 400;\">Under <\/span><b>Article 32(3) of the Law on Tourism of the Republic of Lithuania<\/b><span style=\"font-weight: 400;\">, all accommodation providers in Lithuania are required to register each guest in the national <\/span><b>E.tourist system<\/b><span style=\"font-weight: 400;\"> (National Tourism Information System). Upon arrival, all guests must present a valid identity document. I\u0161samesn\u0119 informacij\u0105 rasite m\u016bs\u0173 <a href=\"https:\/\/comfyrest.eu\/en\/privatumo-politika\/\">Privacy Policy<\/a>.<\/span><\/p>\r\n<p><b>6.6 Right of access. <\/b><span style=\"font-weight: 400;\">We or our authorised representatives reserve the right to access the Property at reasonable times for essential repairs, safety inspections or emergencies. Except in emergencies, we will give at least 24 hours advance notice.<\/span><\/p>\r\n<h4><b>7. Use of the Property and house rules<\/b><\/h4>\r\n<p><b>7.1 Permitted use. <\/b><span style=\"font-weight: 400;\">The Property is provided exclusively for holiday accommodation purposes. The Property may not be used for any commercial purposes, sublet or transferred to third parties.<\/span><\/p>\r\n<p><b>7.2 Maximum occupancy. <\/b><span style=\"font-weight: 400;\">The maximum number of persons permitted to stay overnight at the Property is stated in the Property listing and in the Booking Confirmation (including children of all ages). Only persons named in the booking or subsequently confirmed by us in writing may stay overnight. If more persons than permitted are staying at the Property, we reserve the right to: (a) require the excess persons to leave immediately; or (b) terminate the booking immediately without refund.<\/span><\/p>\r\n<p><b>7.3 House Rules. <\/b><span style=\"font-weight: 400;\">The House Rules for each Property are published on the Property listing page, included in the Booking Confirmation and available at the Property. By completing the booking, you confirm that you have read and agree to the House Rules. <\/span><b>The House Rules form an integral part of this Contract.<\/b><span style=\"font-weight: 400;\"> A material breach of the House Rules may result in immediate termination of the booking without refund.<\/span><\/p>\r\n<p><b>7.4 Smoking. <\/b><span style=\"font-weight: 400;\">Smoking (including electronic cigarettes and vaping devices) <\/span><b>strictly forbidden<\/b><span style=\"font-weight: 400;\"> in all Properties. A minimum cleaning fee applies for breach of this policy: <\/span><b>100 \u20ac<\/b><span style=\"font-weight: 400;\">. If the actual cleaning costs exceed this amount, the Guest is liable for all costs. Repeated breach may result in immediate termination without refund.<\/span><\/p>\r\n<p><b>7.5 Pets. <\/b><span style=\"font-weight: 400;\">Augintiniai leid\u017eiami tik Svetain\u0117je ai\u0161kiai pa\u017eym\u0117tuose Objektuose. Mes negarantuojame, kad ankstesni sve\u010diai nebuvo atve\u017e\u0119 augintini\u0173 \u012f Objekt\u0105.<\/span><\/p>\r\n<p><b>7.6 Quiet hours and noise. <\/b><span style=\"font-weight: 400;\">Guests must maintain a reasonable noise level at all times. Under the Lithuanian Law on Noise Management (No. IX-2499), quiet hours are observed daily from <\/span><b>22:00 to 08:00<\/b><span style=\"font-weight: 400;\">. During quiet hours all outdoor activities must cease and the volume of music and entertainment must be reduced so as not to be audible beyond the Property boundaries. <\/span><b>Parties, celebrations and group events are prohibited<\/b><span style=\"font-weight: 400;\"> without our prior written consent. Breach of noise rules may result in a formal warning, and repeated or serious breaches may result in immediate termination of the booking without refund, and the Guest may be subject to administrative fines under Lithuanian law (\u20ac80\u2013200 per person).<\/span><\/p>\r\n<p><b>7.7 Illegal activity. <\/b><span style=\"font-weight: 400;\">Any illegal activity at the Property will result in immediate termination of the booking, eviction of all guests and notification of law enforcement authorities. No refund will apply.<\/span><\/p>\r\n<h4><b>8. Our liability<\/b><\/h4>\r\n<p><b>9.1 Scope of liability. <\/b><span style=\"font-weight: 400;\">To the maximum extent permitted by Lithuanian law:<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">(a) Our total cumulative liability for all claims relating to a single booking shall not exceed the total Rental Amount paid by the Guest for that booking.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">(b) We are not liable for any indirect, incidental or consequential losses, including but not limited to: loss of enjoyment; additional travel or accommodation costs; loss of earnings or income; or any non-pecuniary loss \u2013 except where such limitation of liability is prohibited by law.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">(c) We are not liable for: temporary utility disruptions; noise or disturbance from neighbouring properties, construction, public works or events beyond our control; adverse weather conditions; changes to local amenities, shops, restaurants or public services; acts or omissions of third parties unconnected with the performance of our Contract.<\/span><\/p>\r\n<p><b>9.2 Duty to mitigate. <\/b><span style=\"font-weight: 400;\">The Guest must take reasonable steps to mitigate losses. In particular, if a problem arises during the stay, you must inform us immediately (see clause 11.1) so that we can resolve it before seeking alternative accommodation or incurring additional costs.<\/span><\/p>\r\n<h4><b>10. Force majeure<\/b><\/h4>\r\n<p><b>10.1 <\/b><span style=\"font-weight: 400;\">Neither party shall be liable for any failure or delay in performing their obligations under this Contract if such failure or delay arises from <\/span><b>force majeure circumstances<\/b><span style=\"font-weight: 400;\"> under Article 6.212 of the Civil Code of the Republic of Lithuania and Government Resolution No. 840 (15 July 1996), including but not limited to: war or armed conflict; terrorism; natural disasters; epidemics or pandemics; government-imposed restrictions, quarantine measures or border closures; fire or explosion; prolonged electricity or infrastructure failure; strikes or industrial action; and any other event beyond the reasonable control of the affected party, provided that the four conditions of Article 6.212 are satisfied.<\/span><\/p>\r\n<p><b>10.2 Notification. <\/b><span style=\"font-weight: 400;\">The party affected by force majeure must <\/span><b>promptly<\/b><span style=\"font-weight: 400;\"> notify the other party in writing upon becoming aware of the force majeure event, stating the nature and expected duration of the event. Exemption from liability takes effect from the date the obstacle arose, if notice is given in time, or from the date of notification if notice is delayed.<\/span><\/p>\r\n<p><b>10.3 Consequences. <\/b><span style=\"font-weight: 400;\">Force majeure atveju, kai Sve\u010dias negali atvykti \u012f Objekt\u0105 arba Comfy Rest negali suteikti Objekto pagal Sutart\u012f:<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">(a) The Guest will be offered the choice of: (i) rescheduling dates within <\/span><b>12 months<\/b><span style=\"font-weight: 400;\"> (priklausomai nuo prieinamumo ir kainos skirtumo); arba (ii) gr\u0105\u017einti visas sumok\u0117tas sumas, at\u0117mus bet kokias pagr\u012fstas neatgautinas Comfy Rest patirtas i\u0161laidas (dokumentuotas ir detaliai nurodytas) ir administracin\u012f mokest\u012f, nevir\u0161ijant\u012f \u20ac50.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">(b) Neither party shall be entitled to compensation for consequential or indirect losses arising from force majeure.<\/span><\/p>\r\n<p><b>10.4 <\/b><span style=\"font-weight: 400;\">If the force majeure circumstance continues for more than <\/span><b>60 days<\/b><span style=\"font-weight: 400;\">, either party may terminate the Contract by written notice, and any refund will be made in accordance with clause 10.3(a)(ii).<\/span><\/p>\r\n<h4><b>11. Complaints and dispute resolution<\/b><\/h4>\r\n<p><b>11.1 During the stay. <\/b><span style=\"font-weight: 400;\">If any problem arises during the stay, please contact us immediately on +37064569999 or by email at rest@comfyrest.lt. Many issues can be resolved quickly if reported promptly. Complaints regarding cleanliness must be submitted within <\/span><b>4 hours<\/b><span style=\"font-weight: 400;\"> of arrival. We aim to resolve issues during the stay wherever possible.<\/span><\/p>\r\n<p><b>11.2 After the stay. <\/b><span style=\"font-weight: 400;\">If a complaint was not resolved during the stay, you must submit a written complaint by email to rest@comfyrest.lt within <\/span><b>14 days<\/b><span style=\"font-weight: 400;\"> of the end of the Rental Period, providing a clear description of the problem and any supporting evidence (photographs, correspondence). If you do not receive a satisfactory response within 14 calendar days, you may submit a complaint to SCRPA.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">For cross-border disputes within the EU, the European Consumer Centre Lithuania (ECC Lithuania) may provide assistance: www.ecc.lt<\/span><\/p>\r\n<p><b>11.4 Applicable law. <\/b><span style=\"font-weight: 400;\">This Contract shall be governed by and construed in accordance with the law of <\/span><b>the Republic of Lithuania<\/b><span style=\"font-weight: 400;\"> .<\/span><\/p>\r\n<p><b>11.5 Jurisdiction. <\/b><span style=\"font-weight: 400;\">Any disputes arising out of or in connection with this Contract that cannot be resolved through the ADR procedure above shall be determined by the competent courts of the Republic of Lithuania.<\/span><\/p>\r\n<h4><b>12. Personal data protection and privacy<\/b><\/h4>\r\n<p><b>12.1 <\/b><span style=\"font-weight: 400;\">Comfy Rest (UAB Limo Trading Company) yra <\/span><b>data controller<\/b><span style=\"font-weight: 400;\"> for personal data collected through the Website and in the provision of accommodation services.
